Public Comment

The FTC’s broad 2024 “click-to-cancel” amendments were vacated, and in February 2026 the FTC restored the older Negative Option Rule text. In March 2026, the FTC opened a new rulemaking process asking for public comment on negative option programs, including enrollment and cancellation practices. The practical question is whether cancellation should be as easy as signup, or whether a strict federal rule would overburden legitimate subscription businesses and duplicate state laws. If I can sign up in two clicks, I should not have to call during business hours and argue with a retention script to cancel.
